Man accused in fatal shooting of neighbor pleads not guilty to murder charge

SAN DIEGO (CNS) - A 20-year-old man accused of fatally shooting a neighbor outside their Mountain View apartment complex last month pleaded not guilty Friday to a murder charge.

Freddy Ovdulio Pacheco, who was ordered held on $2 million bail, faces 50 years to life in prison if convicted.

Pacheco was arrested Wednesday at his family's residence in the 200 block of South 35th Street in connection with the slaying of Juan Carlos Martinez, a 44-year-old construction worker, SDPD homicide Lt. Jorge Duran.

Deputy District Attorney Jalyn Wang told Judge Michael Smyth that Pacheco fired five shots at the victim as he rode his bicycle home from an errand about 7 p.m. Oct. 18.

Martinez was hit twice, once in the buttocks and then in the back, which was the fatal shot, the prosecutor said. He died at the scene.

The motive for the slaying was unclear, though the two men apparently were acquainted and may have had some sort of prior "falling-out," Duran said

The murder weapon, a pistol, has not been recovered, according to police.

A status conference was scheduled Nov. 20 and a preliminary hearing for Nov. 27.
