SAN DIEGO (CBS 8) - A former San Diego city official is contradicting comments made by Mayor Bob Filner's lawyer about sexual harassment training. The city's former chief operating officer says it was the mayor's office that canceled the training, not the city.
Filner's private attorney Harvey Berger is standing by what he says, arguing his client's legal bills should be paid by the city because it failed to provide him with sexual harassment training. But a new report is claiming the mayor's office canceled those multiple training sessions in his first months in office.
Berger is blaming the city for not providing sexual harassment training within his first six months in office, which is required by state law. In a letter to City Attorney Jan Goldsmith, Berger wrote, "In fact it is my understanding that such training was scheduled, but the trainer for the city unilaterally canceled and never rescheduled such training for the mayor."
In response to that letter to the city attorney, former city chief operating officer Jay Goldstone told voiceofsandiego.org that the mayor's office ordered the sessions to be canceled because it didn't have time for them.
"Absolutely not. I am 100 percent certain that (the city) did not cancel it," Goldstone said.
He goes on to say the mayor's office eventually relented and held one training session that covered only benefits, after they were told they wouldn't receive their benefits without the training.
According to a certificate of completion, Mayor Filner completed the mandated sexual harassment training on July 15 -- about six weeks late.
