Despite acquittal, Richard Tuite remains in jail

SAN DIEGO (CBS 8) - Richard Tuite remains behind bars Monday, days after being acquitted of voluntary manslaughter in the 1998 killing of Stephanie Crowe. So why is he still in custody?

In 2004, Tuite escaped custody, so a four-year term was added to his 13-year sentence. Now that the longer sentence has been voided, Tuite should be released with time served, and may also be eligible for compensation.

If he can prove he was wrongly convicted, the state would owe him $100 per day for the estimated 3,200 days he spent behind bars, which would come to about $320,000.

A hearing is scheduled Tuesday to determine when Tuite will be released.
